Allyson McDermott Collections Terms and Conditions
The terms and conditions are the transaction between Allyson McDermott Collections Limited and its clients, individuals, governmental, or any form of organisation in the U.K. or overseas.
Definitions.
The website, http://www.allysonmcdermott.com including its database rights (hereafter the Allyson McDermott Collections Website) is owned and operated by Allyson McDermott Collections Ltd (hereafter Allyson McDermott Collections).
References to 'we', 'us' and 'our' are deemed to be references to Allyson McDermott Collections Ltd.
When referring to 'you' or ‘your' or ‘client’, this shall be deemed as reference to any persons accessing the Allyson McDermott Collections Website and any persons contacting or placing an order via the Allyson McDermott Collections Website. 'Personal Information' means the details provided by you on registration.
These terms and conditions govern the use of the Allyson McDermott Collections Website and apply to all items ordered from Allyson McDermott Collections Ltd, either via the website or other communication formats.

In regards works of art, all matters artistic, professional judgement, the decision of Allyson McDermott Collections will be final and no disagreement as to the standard of conservation, consultancy, reports, artwork, wallpapers etc will render any invoice in-payable or subject to dispute.
Allyson McDermott Collections does not guarantee that access to the Allyson McDermott Collections Website will be uninterrupted
We make no warranty that the Website will meet your requirements, be timely or error-free, that defects will be corrected, or that the site or server that makes it available will be free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website.
The Allyson McDermott Collections Website and the information is provided on an ‘as is’ basis, with no warranties of any kind whatsoever, either express or implied, including, but not limited to, any warranties or any implied warranties of merchantability or fitness for a particular purpose. In no event will Allyson McDermott Collections be liable for any damages whatsoever arising out of or related to the Allyson McDermott McDermott Collections Website. Our Rights
We reserve the right to:
Change the Conditions with the immediate updating of the Conditions on the Allyson McDermott Collections Website
Use of the Website (or part thereof) following such change shall be considered your acceptance of such change. It is your responsibility to check Conditions on our Website to update yourself on such changes in advance of all orders.
Charge updated prices for products on orders placed in excess of 6 weeks from the corresponding quote.
Withdraw items from the Allyson McDermott Collections at any time without prior notification.
Discontinue designs in the Allyson McDermott Collections without notification unless a quotation or conversation is taking place directly in relation to that design.
Accuracy of Content
Allyson McDermott Collections makes all reasonable efforts to ensure the accuracy of content, no responsibility can be taken for any error or omission.

Product
Allyson McDermott Collections Ltd have made every effort to provide accurate information in good faith in all areas of the website.
All descriptions, measurements and weights are given by us to you, are stated in good faith but are approximate only and will not bind Allyson McDermott Collections in any way. Allyson McDermott Collections reserves the right to withdraw, amend, the specification of any goods without further notice to you.
Please note, we do not guarantee colour matches between the same products ordered by you in separate orders. We do not guarantee colour and match between wallpaper and fabric with the same pattern.
There may be some colour variation between batches of printing due to the natural characteristics of the materials used. Variations with the paper and fabric used for printing, may have subtle characteristics, natural or otherwise, which we believe gives character and uniqueness to the product and will not be classified as faulty, please be sure you order sufficient.
We have made every effort to display as accurately as possible the colours of our products that appear on the Allyson McDermott Collections Website. However, as the actual colours you see will depend on your monitor, tablet or mobile device, we
cannot guarantee that your monitor,'s tablet or mobile device's display of any colour will accurately reflect the colour of the product on delivery.
All sizes and measurements are approximate. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Allyson McDermott Collections Website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

Please be aware, all prices are subject to change without notice. These changes will not affect orders that have already been dispatched.
Wallpaper and fabrics sold on the Allyson McDermott Collections Website are made to order and are non-stocked items. All orders will only be produced or undertaken on receipt of payment in full of the value of the order.
It is the responsibility of the client to ensure that they are satisfied that all details of your order are correct at the time of ordering and are suitable for your
requirements. This includes all measurements, dimensions, product features and delivery. Allyson McDermott Collections is not responsible for any implications resulting from incorrect details provided.
When you place an order on the Allyson McDermott Collections Website you will receive an order confirmation. Once you have checked out, and have received your order confirmation you will not be able to make any changes to your order. Please make sure that everything is correct before clicking the 'PAY’ button.
We recommend that when ordering wallpapers or fabrics that professional advice is sought. Allyson McDermott Collections can only advise suitable meterage of products in good faith, but does not take responsibility for over or under ordering of products. Any additional orders as a result of under ordering will be treated as a separate order and cannot be added on to the previous order.
We reserve the right to refuse an order. If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time. We will take all necessary measures to keep the details of your order and payment secure.
To be eligible to purchase products on this website you must be over 18 years of age, register by providing your real name, phone number, email address, payment details and other requested information and also provide a valid delivery address and a valid credit or debit card issued by a bank acceptable to us. Please note that PO box numbers and temporary addresses are not permitted.
Allyson Mcdermott Collections has carefully selected manufacturers to implement where necessary to implement the unique quality that our designs command. Many of these manufacturers employ traditional processes using naturally dyed yarns, inks, mixing print colours by hand, and erasing with natural fibers. Whilst rigorous quality control checks are performed with
commercial tolerance levels, we cannot guarantee complete uniformity from batch to batch due to the traditional manufacturing techniques. Samples received by post or in the studio can be cut from a different batch to your order. If your order is coming from stock, we recommend requesting a sample from the batch from which your fabric or wallpaper is being cut. If your fabric or wallpaper is being woven or printed to order and you have a previous sample as a reference and a close match is required, we recommend sending this sample to us for reference.
Registration with Allyson McDermott Collections.
You agree that:
All the personal information which you provide when registering as a Client is true, accurate, current and complete.
In order to keep our record of your Client information up to date, it is in your interest to notify the studio of any company name, company contacts or address changes.
You agree not to impersonate any other person or entity, or to use a false name or a name that you are not authorised to use.
We confirm that all Personal Information which you provide us and any User Information from which we can identify you is held only for the following purposes:
Processing your orders
For analysis to improve our Website and its services to you Serve Website content and advertisements to you
To administer the Website
If you consent, to notify you of events, products or special offers that may be of interest to you You agree that you do not object to us contacting you for any of the above purposes whether by telephone, email or in writing, and you confirm that you do not and will not consider any of the above as being in breach of any of your rights under the GDPR Act 2018.
Pricing.
All prices stated on the website are correct at the time of publishing, but may change due to circumstances beyond our control.
Prices include VAT, but exclude delivery charges and import duties. Customers will pay postal/shipping costs at check-out. Customers outside the United Kingdom are liable for additional import duties.
Allyson McDermott is not liable for import duties for international shipments outside the United Kingdom.
Delivery prices are charged in addition to product prices. UK delivery costs are set for lengths up to 60m. UK orders in excess of 60m and
non-domestic orders are quoted on a case-by-case basis.
Payment
When you are emailed an invoice please check that all the information included is correct.
That the wallpaper, fabric or project is correct, the details included are accurate for the quantity or product listed.
The contact information is correct.
If the item listed is being sent to a third party, that the delivery address is correct. We are not responsible for re-shipping the order.
When the invoice has been paid we presume all the information is correct and will continue to order and ship using the information provided on the invoice.
Payments can be made on the website with credit cards, Paypal .....
All other transactions can be made by contacting the studio directly or payment by BACS, with details provided on the invoice.
All wallpaper and fabric orders, reinstallation must be paid 100% upfront before dispatch, unless otherwise agreed.
Interest.
Will be charged on all outstanding invoices over 14 days. Allyson McDermott Collections reserves the right to charge interest on all outstanding balances at the rate of 5% above the Barclays Base Rate on the day of interest being incurred.
VAT.
20% VAT may be withheld if orders are removed from the UK. However, for VAT audit we must retain evidence of movement of the goods. If we arrange shipping our agent will provide this. For orders remaining within the EU you must supply your VAT registration in the state of acquisition before the supply can be treated as VAT free in the UK. The VAT rate is current and subject to change.
Conservation.
Due to the nature of the work, an invoice for 30% of all works will be invoiced before the start of the commencement of works.
Thereafter interim payments will be invoiced to the client at agreed times. Until all payments are received, within the timeframes indicated, 10 days, works will cease until payment is made.
From time to time prices may be changed without informing you, this does not affect your statutory rights.
Items are only released after the final payment has been received.
Unless stated otherwise our estimates for conservation and bespoke works are not firm quotations. Should unforeseen problems arise, indicating an increase of more than 10% of the original estimate, Allyson McDermott will inform the client and await a response before proceeding further.
Bespoke printing.
Costs will be charged in full for set-up, artwork and printing, visitations after the agreement of the client and the signing off of plans and artwork and the acceptance of the invoice. By the client.
Work will not commence until the initial invoice has been paid.
Allyson McDermott Collections reserves the right to charge the client for any additional materials or changes to the artwork or design after the works have been signed off by the client, printing or method statement
Cancellation.
Allyson McDermott Collections reserves the right to charge the client a cancellation fee for short notice cancellations. Within 2 weeks 100%, within 4 weeks 50% of the total agreed price.
Measurements.
All measurements and drawings are the responsibility of the client. Allyson McDermott Collections takes no responsibility for inaccurate information provided by the client or a third party.
Once the project order is processed Allyson McDermott Collections reserves the right to charge accordingly fees to correct and change any errors in the order.
Allyson McDermott Collections can organise to have a room measured, please contact the studio. This will incur the appropriate fee for the site visit.

Delivery.
All orders will be shipped by Allyson McDermott Collections within 48 hours after production, not including weekends and public holidays. You will receive a shipment confirmation email with the shipping tracking number when the order has been dispatched.
For orders outside of the United Kingdom local customs duty will be charged to you depending upon the country in which you reside. Allyson McDermott Collections is not responsible for payment of this duty. The shipping company will contact you once your items are in customs to let you know the cost. Be aware that this may delay your delivery time as goods are held at customs. It will be your responsibility to pay the necessary charges for local authorities to release the goods.

We shall not be liable for delays and/or failures in delivery due to procedures outside our control.
Please be advised, all delivery dates are not guaranteed by Allyson McDermott Collections.
Loss or Damage
Allyson McDermott Collections carries the risk of loss or damage to the ordered products until you receive them. The products belong to you when you have received them and have paid us in full. If you return the products to us for any reason, they will become our property and be at our risk from the time we receive them.
Please note that you have a legal obligation to take reasonable care of the items while they are in your possession and we hold the right to deny returns if the merchandise returned does not meet our policy requirements.
Returns.
All Allyson McDermott Collections products are made to order only. We do not accept returns unless the product is,
1. damaged in transit before you receive them or
2. if the product is faulty.
All goods are dispatched suitably packaged for transit purposes only. You should inspect the goods upon delivery and check that no items are damaged. If goods are damaged you should state such upon receipt of delivery and contact info@allysonmcdermott.com within 5 days of delivery, including photographic evidence of the damage.
Allyson McDermott Collections does not take responsibility for goods that have been damaged after delivery as a result of poor handling or storage.
For EU orders,
Please organise a return shipment using your preferred courier. Please note you will be fully responsible for payment of all return shipping costs.
For international orders (outside of the EU),
Please email us at info@allysonmcdermott.com and we will create a return shipping label and deduct the cost from the amount to be refunded. If you organise your own return shipment, you will be responsible for any taxes and duties incurred.
Items should be returned within 15 days to: Allyson McDermott Collections,

If the item returned meets our return terms, any sum debited from your credit or debit card will be re-credited to your account as soon as the goods are received and processed, excluding the initial shipping cost.
Please note, we will not cover decorator costs or any other additional costs that arise as this is solely your responsibility.
All the fabric is printed to order so we cannot offer a refund after you have paid for the fabric unless it is faulty. Please check your wallpaper or fabric for faults before you cut.
NOTE: If the wallpaper or fabric has been cut or made up we cannot offer any refunds.
If you are sending fabric direct to a curtain maker please make sure they have checked they have the correct fabric. If you arrange to have fabric sent to a third party without checking it yourself first, it is at your own risk.
If you have any problems with the fabric you need to inform us of the problem within 10 days from delivery
Insurance.
Items will not be covered by our insurance whilst in the studio, unless specifically agreed with the client.
The client is responsible for providing evidence of valuation, in advance of removal. All insurance cover agreed between Allyson McDermott Collections and the Client will cease two weeks after the notification of the completion of works in the studio.
All products ordered from the website will be responsibility of Allyson McDermott Collections prior to dispatch to the client and until the items are received by the client.
Fabrics.
Allyson McDermott Collections fabrics are not FR treated and will need to be treated or interlined in order to comply with FR standard regulation. We recommend buying 1 meter / 1 yard of fabric or wallpaper to issue for testing.
Crib 5, Scotch guarding and other such treatments must be outsourced by the client and handled directly with the treatment supplier.
Allyson McDermott Collections cannot take responsibility for poor treatment results or incorrect treatment of our fabrics or wallpapers given our stipulation to issue the supplier with clear instruction of works in addition to the testing of 1 meter / 1 yard in advance of full meterage / yardage treatment.

In no circumstances will any other jurisdiction apply to work carried out by Allyson McDermott Collections, irrespective at which work is undertaken.
No part of the Allyson McDermott Collections Website, including all images, information, logos, the overall appearance of the site, may be copied, republished, or reproduced in any form whatsoever, without the prior written permission of Allyson McDermott Collections.
You also agree, on entering the Allyson McDermott Collections Website, not to adapt, alter or create a derivative work from the site content except for your own personal, non-commercial use.

Site, Consultation Visits and Reports.
Any report by Allyson McDermott Collections is protected by copyright and remains at all times the intellectual property of Allyson McDermott Collections and may not be copied or reproduced without prior agreement.
We will not be responsible for any treatment carried out on the basis of the report by Allyson McDermott Collections by any person not specifically employed or subcontracted by Allyson McDermott Collections.
Prior to undertaking any work onsite, Allyson McDermott Collections requires written assurances the site is structurally sound and that all hazards such as asbestos have been properly assessed and the appropriate measures undertaken.
The client will be responsible for the provision of a safe, clean scaffold or other access equipment, floor protection, lightening, power, heating, Health and Safety monitoring and all legislative or statutory requirements, unless agreed to the contrary in advance.
Allyson McDermott Collections will not accept any legislative responsibility or legal liability unless specifically agreed beforehand.
Privacy and Data protection.
Allyson McDermott Collections will respect the privacy of your personal data, and will comply with all relevant and current data protection legislation. We will not disclose your personal data to anyone, unless required to do so by a court of competent jurisdiction.

Amendments to Terms and Conditions.
Allyson McDermott Collections reserves the right to amend our terms and conditions at any time. Any amendments will take effect when posted on the Allyson McDermott Collections Website and it is your responsibility to read the terms and conditions on each occasion you use the Allyson McDermott Collections Website. The continued use of the Allyson McDermott Collections Website shall signify your acceptance to be bound by the latest terms and conditions.
